In January 2025, PowerSchool announced that it had been hacked in late December 2024. Subsequently, it was reported that over 62 million student records and nearly 10 million teacher records were affected, making this one of the largest breaches of children’s information in U.S. history.

The EdTech Law Center, in a suit against PowerSchool filed in May 2024, warned that “[b]y collecting vast amounts of data from both students and their families, PowerSchool puts that data at risk.” Only eight months later, that warning came true.

Dozens of cases were filed in the days and weeks following the announcement, eventually rising to 55 cases in nine districts at the time one of the plaintiffs moved to centralize the proceedings under 28 U.S.C. § 1407. The plaintiffs asserted nearly identical claims for negligence, breach of contract, and unjust enrichment.

On April 8, 2025, the United States Judicial Panel on Multidistrict Litigation issued an order transferring the cases to the Southern District of California and assigning the MDL to Judge Roger T. Benitez.
