Reisberg v. Seesaw Learning, Inc., Case No. [TKTKTK], California Superior Court, County of Orange

On May 7, 2025, Plaintiffs, California K-12 students, sued Seesaw, a digital portfolio platform that collects and retains students’ photo images, videos, audio recordings, and student created content. Seesaw purports to reserve for itself sweeping rights to this information, including the right to export, display, and make derivative works of this information as well as of the voices and likenesses of students. The complaint alleges that Seesaw collects, stores, and uses this information without proper consent.

Plaintiffs assert the following claims:

  1. the California Invasion of Privacy Act (CIPA);
  2. California Comprehensive Computer Data Access and Fraud Act (CDAFA);
  3. California’s Unfair Competition Law;
  4. Invasion of privacy under California’s constitution;
  5. Common law invasion of privacy for the public disclosure of private facts;
  6. (Common law intrusion upon seclusion; and
  7. Unjust enrichment.
